Toys R Us settles disability discrimination lawsuit

Workplace discrimination can come in many forms under several different circumstances, and all of them are illegal in Michigan as well as the rest of the country. This year, a lawsuit was filed by the federal Equal Employment Opportunity Commission against Toys R Us Inc. for denying employment to a deaf applicant. The discrimination suit has recently been settled for $35,000.

The lawsuit, which was originally filed in March, alleges that Toys R Us denied a qualified job applicant a position because she is deaf. After the applicant applied for the job, she was invited for a group interview. Her mother informed Toys R Us that the applicant was deaf and needed an interpreter, but Toys R Us refused to provide an interpreter.

The applicant's mother had to be the interpreter at the meeting, and afterwards, Toys R Us refused to hire her, despite her qualifications and abilities with or without accommodations. The EEOC charged Toys R Us for violating the Americans with Disabilities Act. Toys R Us decided to settle for $35,000 dollars and a three year consent decree enjoining Toys R Us from future employment discrimination.

Employment discrimination because of an applicant's disability is illegal in all states, including Michigan. If any citizen feels that they have been discriminated against in the workplace because he or she has a disability, that person may be entitled to pursue an employment discrimination lawsuit.
