Understanding MIOSHA standards

Employees in Michigan might be interested in understanding more about the rights and responsibilities given to them by the Michigan Occupational Safety and Health Administration. According to MIOSHA regulations, employers are required to inform employees of obligations or protections provided by MIOSHA, including statutes describing any applicable standards or regulations.

Employers are also liable for providing personal protective equipment that complies with MIOSHA standards. The appropriate equipment is to be provided at the employer's expense. If an employer is requesting any variance from MIOSHA standards, the employee must be provided with adequate notice and have the opportunity for a formal hearing. If an employee suspects the employer is in violation of a workplace laws, the employee has a right to request an MIOSHA inspection via written notice.

Employees also have the right to request their identity not be disclosed to the employer if an inspection occurs. MIOSHA grants employees the right to receive notification if an inspection will not be scheduled. If an imminent danger exists in the workplace, employees have the right to contact MIOSHA immediately without written notice. Employees also have the right to attend meetings between the employer and MIOSHA representatives.

Employees who have questions about the protections provided by MIOSHA may benefit from consulting legal counsel. Lawyers might be able to protect employees' rights as described by MIOSHA and federal laws. Legal counsel may also be effective in investigating allegations of an employer's failure to keep employees informed of their rights. Whistleblowers and employees victimized by discrimination might benefit from obtaining legal representation as well.
