Discrimination against Michigan employees with disabilities

Discrimination against a disabled employee or job applicant is prohibited when that person is denied an opportunity due to his or her disability. To qualify as discrimination under the Americans With Disabilities Act, the employee or job applicant must otherwise be qualified to fill a given position. Discrimination may also occur if an individual is denied an employment opportunity because of a relationship with someone who has a disability.

Court upholds Christian group's firing of divorced worker

A woman in Michigan lost her appeal after a court ruled in favor of her employer's decision to fire her for getting a divorce. The woman's former employer, InterVarsity Christian Fellowship, won the case by asserting the ministerial exception to federal employment discrimination laws. Although IVCF is not a church, the federal appeals court said that the religious organization was still entitled to invoke the ministerial exception.

Superintendent fired twice by school board

According to sources, the Clio, Michigan, school board voted twice in eight days to fire the former superintendent of the district. The initial vote came on Jan. 19, but then, the charges against the superintendent were amended by the board, so a second vote occurring on Jan. 27 again resulted in his being fired.

Michigan employee fights for family and medical leave benefits

In a case of alleged wrongful termination, an 18-year veteran of a county road commission won a partial victory from the U.S. Court of Appeals for the 6th Circuit. The man can continue his legal actions against his former employer regarding his right to claim Family and Medical Leave Act benefits.
