Superintendent fired twice by school board

According to sources, the Clio, Michigan, school board voted twice in eight days to fire the former superintendent of the district. The initial vote came on Jan. 19, but then, the charges against the superintendent were amended by the board, so a second vote occurring on Jan. 27 again resulted in his being fired.

The allegations by the board against the superintendent include an accusation that pornography was found on three district-issued computer devices. The superintendent claims he did not have access to any of the computers, however. District officials also claim that an audit conducted by a law firm revealed commingling of funds, twice-paid invoices and mismanagement of the administrative office and budget.

For his part, the superintendent has filed a whistleblower lawsuit against the school district, claiming they have engaged in a pattern of retaliation against him for revealing illegal activities. He was suspended in April 2014 for unknown reasons and was then reassigned to head the Clio Community education program, an alternative education high school run by the district. Following his suspension, he filed his lawsuit and was then reassigned as the superintendent of Clio Community High School. The superintendent claims the district has fired him because they were paying two superintendent salaries with taxpayer money due to their own actions.

Retaliatory action by an employer for whistleblowing is prohibited by law. There are state and federal whistleblower protection laws in place. When an employer does retaliate, it may face liability for doing so. Building a whistleblower case often involves significant investigation prior to filing.
