Can you record conversations with your phone to prove harassment?

If you're enduring sexual harassment at work, recording evidence on your phone is not only possible, but experts say it's a rising trend. Employees have found that it's easy to record conversations with a modern smartphone, and they can then use these conversations to prove they were being harassed or discriminated against.

Some experts have even said that it can be easier to reach a settlement quickly if a video or audio recording is present. When shown that there is direct proof that something occurred, companies may want to simply pay up and avoid the long, drawn-out process of a court case, which can create bad publicity.

So, how feasible is this? One man used his phone to make hours of recordings when he felt the hospital he worked at was not treating him fairly. He claimed that a supervisor was sexually harassing him. Rather than going to the authorities, he simply went to Human Resources and asked if they could move him to another area.

At first, they said they'd do it, but the man claims they then started backing off of those promises. That's when he started recording all of the conversations he had with supervisors and reps from HR, some of which allegedly include people yelling at him and telling him to leave the hospital.

The thing that is most important to note in Michigan, though, is that everyone has to consent to having a conversation recorded, or it can't be used as evidence. While you can record conversations and use those recording, they have to be made legally or they'll be thrown out. Be sure you know how these laws work before starting a case.
