Your termination rights as an at-will employee in Michigan

Do you understand what "at-will employment" means? Most states, including Michigan, abide by the at-will employment doctrine. What it means is that you can be terminated from your job at any time, even if your employer gives no reason for the termination. This can be done with or without a notice of termination. It also means that you can leave your job at any time with or without providing a reason or a notice.

Many people believe that at-will employment precludes them from taking action if they believe the termination was wrongful. This is definitely a myth. Even though you can be fired at any time, your employer may not do so if it violates your employee rights or breaks employment laws. Below are a few situations in which an employer may not terminate your employment.

-- Your age: It is unlawful to fire a worker solely on the basis of age.

-- Your gender: It is against employment law to terminate an employee due to his or her gender.

-- Your pregnancy: Employers may not terminate a female worker if she is pregnant or if she becomes pregnant.

-- Your disability: Under the Americans with Disabilities Act, employers may not fire a worker solely because of a disability.

-- Your religion: Americans have a right to freedom of religion and as such may not be terminated because an employer disagrees with their chosen religion.

Admittedly, it can be difficult to prove your termination was in violation of your employee rights alone.
