Disabilities Do Not Make It OK To Be Discriminated Against

Having a disability by no means precludes you from pursuing a career and making an impact in your profession. However, far too many employers only look at the bottom line and balk at the reasonable accommodations you need to be productive. That’s why we, as disability discrimination attorneys, are here to help.

At Akeel & Valentine, PLC, our attorneys have a long reputation in Detroit and nationwide as dedicated lawyers who pursue justice. Our clients are people facing uphill battles in the workplace simply for the right to contribute. When you come to us, we will take your case and promise our strength and dedication to you.

Understanding Reasonable Accommodations

A key aspect of the federal Americans With Disabilities Act (ADA) and Michigan’s Persons with Disabilities Civil Rights Act is reasonable accommodation. These accommodations are changes to duties or workspaces that allow people with disabilities to work. Common accommodations can be:

  • Allowing more work-from-home opportunities
  • Adding ramps to the building
  • Changing desk size or arrangement in the office
  • Special equipment to assist workers with disabilities

These accommodations make workplaces usable for people with mobility issues, deafness, blindness or mental health conditions. In many cases, accessibility also makes workplaces more hospitable for nondisabled individuals. There’s so much logic to adding accessibility options.

However, the argument against these things is often made because of costs or worries about culture. Neither of those arguments, however, stands up to the law. The only time a company can refuse to accommodate someone with a disability is if the accommodation causes “undue hardship,” and to accomplish that, your company needs to prove that the requested accommodation is unreasonable in terms of scope and cost.
